SB 311, the ACE Act, would amend the federal tax code to create incentives that expand education choice for families.
Senate Bill 311, the Achieving Choice in Education Act (ACE Act), would amend the Internal Revenue Code of 1986 to create new tax incentives for education. Sponsored by Sen. Mike Lee with Sens. Ted Budd and Eric Schmitt as cosponsors, the bill uses the federal tax code — not new spending programs — to expand support for school choice. It was introduced in the U.S. Senate and referred to the Committee on Finance, which holds jurisdiction over tax legislation.
The American Council supports the ACE Act because parents, not federal bureaucracies, are best equipped to choose the education that fits their children's needs. Tax incentives that make scholarships and alternative schooling more affordable put real decision-making power back in families' hands, rather than locking children into a single school assignment based on ZIP code. Expanding school choice at the federal level reinforces our commitment to parental rights and educational freedom nationwide.
As of January 29, 2025, SB 311 has been read twice and referred to the Senate Finance Committee, where it awaits further action. No hearing or committee vote has yet been scheduled, and we will continue to track its progress.
